Samenvatting — WWFT-training
Wat is witwassen en terrorismefinanciering?
- Witwassen: criminele opbrengsten een legale herkomst geven, via plaatsing, versluiering en integratie.
- Terrorismefinanciering: financiering van terroristische activiteiten, vaak via kleine, op zichzelf legale bedragen — niet per se grote sommen.
- In Nederland naar schatting € 15–20 miljard per jaar witgewassen (€ 40–55 miljoen per dag) — vermoedelijk slechts het topje van de ijsberg.
- Geen enkele sector springt er sterk uit; financiële instellingen, vastgoed, horeca, cash-bedrijven en crypto staan bovenaan.
Herkomst van de wetgeving
- FATF (1989, G7) → Europese antiwitwasrichtlijnen (sinds 1991, nu de zesde) → nationale WWFT (2008, daarvoor WID/MOT).
- Ontwikkeling van rule-based naar principle-based, en vanaf 10 juli terug naar een strengere, evidence-based aanpak via de Europese AMLR-verordening, die de WWFT vervangt en rechtstreeks werkt. Toezicht op grote partijen komt vanaf 2028 bij AMLA.
Wie valt onder de WWFT?
Belastingadviseurs, accountants en administratiekantoren (incl. salarisadministratie voor specifieke taken zoals salarisverwerking, niet voor uitbetaling). Het gaat om de aard van de activiteit, niet de titel.
Toezicht en handhaving (BFT)
- Reguliere onderzoeken (thema's) en bijzondere onderzoeken (naar aanleiding van een signaal).
- Handhaving: waarschuwing → last onder dwangsom/aanwijzing → strafrechtelijke aangifte → tuchtklacht. Boetes worden gepubliceerd met naam en toenaam.
Kernverplichtingen
Op kantoorniveau: risicobeleid (dynamisch, op maat van de klantenkring), eventuele compliance-functie, opleiding en screening van medewerkers.
Per klant/dossier:
- Risicoprofiel bepalen (laag/normaal/hoog)
- Cliëntenonderzoek: identificatie + verificatie, doel en aard van de relatie, UBO vaststellen, vertegenwoordiger checken
- Monitoring tijdens de relatie (periodiek + bij trigger events)
- Melden van ongebruikelijke transacties bij de FIU
- Bewaren én tijdig vernietigen van gegevens (AVG)
UBO
Iemand met >25% aandelen/stemrecht/economisch belang of anderszins zeggenschap. Altijd doorzoeken tot een natuurlijk persoon — pseudo-UBO alleen als allerlaatste redmiddel. UBO-register is gesloten geweest na een EU-Hofuitspraak; gefaseerde toegang volgt, gewaarmerkt uittreksel intussen verplicht, niet blind op vertrouwen.
Diepgang van onderzoek
- Vereenvoudigd: nauwelijks nog gebruikt.
- Normaal: standaard.
- Verscherpt: verplicht bij hoog risico, hoogrisicolanden, complexe transacties of een PEP. Vraagt extra info (o.a. source of funds/wealth) en vaker actualiseren.
PEP's
Politiek prominente personen én hun familie/naaste geassocieerden, ook tot een jaar na aftreden. Herkenning via vragenlijst, eigen onderzoek of commerciële databanken.
Meldplicht ongebruikelijke transacties
- Subjectieve indicator: vermoeden op basis van eigen onderzoek → melden zodra intern vastgesteld.
- Objectieve indicator: contante (voorgenomen) transactie ≥ € 10.000 → altijd melden, geen onderzoek nodig.
- Tippingoff-verbod: nooit de klant (of ruim binnen het kantoor) informeren over een melding.
- Bij herhaling: opnieuw melden; geen verplichting om met terugwerkende kracht alles te herbeoordelen.
- Onvoldoende onderbouwde meldingen → geen recht op strafrechtelijke vrijwaring.
Sanctiewetgeving
Geldt voor iedereen, maar voor jullie verweven in de WWFT: klant op een sanctielijst → dienstverlening bevriezen → melden als ongebruikelijke transactie bij de FIU.
Compliance
Compliance- en auditfunctie aanbevolen vanaf circa 50 werknemers of bij een hoog aandeel hoogrisicoklanten. Onboarding en compliance moeten gescheiden rollen zijn.

Summary — WWFT (AML) Training
What is money laundering and terrorist financing?
- Money laundering: giving criminal proceeds a seemingly legitimate origin, through placement, layering and integration.
- Terrorist financing: funding terrorist activities, often via small, individually legal amounts — not necessarily large sums.
- In the Netherlands, an estimated €15–20 billion is laundered per year (€40–55 million per day) — likely just the tip of the iceberg.
- No single sector stands out significantly; financial institutions, real estate, hospitality, cash-intensive businesses and crypto top the list.
Origin of the legislation
- FATF (1989, G7) → European anti-money laundering directives (since 1991, now the sixth) → national WWFT (2008, preceded by WID/MOT).
- Evolution from rule-based to principle-based, and from 10 July onwards back to a stricter, evidence-based approach via the European AMLR regulation, which replaces the WWFT and applies directly. Supervision of large entities will transfer to AMLA from 2028.
Who falls under the WWFT?
Tax advisors, accountants and administrative offices (incl. payroll administration for specific tasks such as payroll processing, not for payment execution). What matters is the nature of the activity, not the job title.
Supervision and enforcement (BFT)
- Regular investigations (thematic) and special investigations (triggered by a signal).
- Enforcement: warning → enforcement order/directive → criminal complaint → disciplinary complaint. Fines are published with full names.
Core obligations
At firm level: risk policy (dynamic, tailored to the client base), a compliance function where applicable, training and screening of staff.
Per client/file:
- Determine risk profile (low/standard/high)
- Client due diligence: identification + verification, purpose and nature of the relationship, UBO determination, representative check
- Ongoing monitoring (periodic + trigger events)
- Reporting unusual transactions to the FIU
- Retaining and timely destroying data (GDPR)
UBO
Anyone holding >25% of shares/voting rights/economic interest or otherwise exercising control. Always trace through to a natural person — pseudo-UBO only as an absolute last resort. The UBO register was closed following an EU Court ruling; phased access is being restored; a certified extract is meanwhile mandatory but must not be relied upon blindly.
Depth of due diligence
- Simplified: rarely used anymore.
- Standard: default.
- Enhanced: mandatory for high risk, high-risk countries, complex transactions or a PEP. Requires additional information (incl. source of funds/wealth) and more frequent updates.
PEPs
Politically exposed persons and their family members/close associates, including up to one year after leaving office. Identification via questionnaire, own research or commercial databases.
Unusual transaction reporting
- Subjective indicator: suspicion based on own investigation → report as soon as established internally.
- Objective indicator: (intended) cash transaction ≥ €10,000 → always report, no investigation required.
- Tipping-off prohibition: never inform the client (or broadly within the firm) about a report.
- On recurrence: report again; no obligation to retrospectively reassess everything.
- Insufficiently substantiated reports → no entitlement to criminal law exemption.
Sanctions legislation
Applies to everyone, but for your firm it is embedded in the WWFT: client on a sanctions list → freeze services → report as an unusual transaction to the FIU.
Compliance
A compliance and audit function is recommended from approximately 50 employees, or sooner when a high proportion of clients are high-risk. Onboarding and compliance must be separate roles.
